TERMS & CONDITIONS - THE SOUL COLLECTIVE

By engaging in any services offered by The Soul Collective, whether in person, online, or at any other location, you do so at your own risk and agree to the following Terms & Conditions.

WAIVER

The Client, along with their heirs and legal representatives, voluntarily waives any future claims against The Soul Collective or any Director, employee, or instructor for any injury, condition, or damages sustained while on the premises, participating in classes, or following advice. The client acknowledges that participation in all sessions is at their own risk.

INTELLECTUAL PROPERTY

All content, materials, and intellectual property associated with The Soul Collective, including but not limited to text, logos, graphics, and course materials, are the exclusive property of The Soul Collective. Unauthorized use or reproduction of these materials is strictly prohibited. By engaging with our services, you acknowledge that you do not acquire any ownership rights to any intellectual property belonging to The Soul Collective.

ENTIRE AGREEMENT

These Terms represent the complete agreement between the parties and exclude any other memoranda, agreements, or understandings of any kind, whether oral or written.

BOOKINGS

  • The costs for each class/session/therapy will be clearly displayed on the website.

  • All bookings will be confirmed through pre-payment via the secure booking system, StudioBookingOnline, or by directly contacting Nathalie for private sessions and accredited training.

  • Ensure you select the correct pricing option for your chosen yoga class (e.g., online, in-person, or concession) or therapy deposit (e.g., Reiki, Reflexology, Reiki Massage, etc.).

  • For courses of sessions, individual bookings must also be made to confirm the chosen time for class/therapy, which will be deducted from your purchased membership/course.

  • 1-2-1 sessions may be booked in the comfort of your home at The Soul Collective's discretion. Ensure a safe space, parking, and access are available. Travel costs may apply

  • The Soul Collective’s services are intended for adults only, unless specified for young people or families. In such cases, it is the parent/guardian's responsibility to ensure the safety of participants under 18.

CHAIR YOGA MEMBERSHIP

  • Our popular Chair Yoga Club Membership is billed monthly to secure individual bookings and is non-refundable/non-transferable, as per members' agreement.

ACCREDITED TRAINING

  • A fully non-refundable/non-transferable deposit will be required at the time of booking, with the full balance due 7 days before the training.
     

BOOKING FOR ANOTHER PERSON

When reserving for a friend or family member, each individual must have their registered account with SimplyBookingOnline. By booking for someone else, both you and that individual agree to our full waiver and terms and conditions.

GIFT VOUCHERS

Gift Vouchers can be purchased through SimplyBookingOnline. Upon payment, an electronic version will be sent to you, or a printed voucher can be collected (free of charge) or mailed to your specified address (postage costs apply). Gift Vouchers can be used as full or partial payment for any services provided by The Soul Collective. They carry full Terms & Conditions and are valid for the specified period. No cash refunds or change will be given.
 

WAITING LIST

All classes, sessions, and workshops/events are subject to availability. When classes are full, a waiting list will be activated. By committing to the waiting list, you agree to the T&C should a spot become available.
 

CHANGE OF PRICES

The Soul Collective reserves the right to review and adjust service prices at our discretion. Prices will not be altered after payment has been made for a specific purchase.
 

CANCELLATION POLICY

Please familiarise yourself with our 12-hour cancellation policy upon booking. By confirming your booking with us, you acknowledge that you have read and accepted our full terms and conditions, including the cancellation policy.
 

HOW TO CANCEL

To avoid penalties, cancellations must be made at least 24 hours before the start time of the class. Once canceled, the class pass will be returned to your account for future use (no monetary refund).
 

LATE CANCELLATIONS & NO-SHOWS

Our goal is to maximise availability for all clients.
 

Class Pass Holders:

  • Early Cancellation (24+ hours notice): Class pass is credited back to your account.

  • Late Cancellation or No Show (less than 24 hours notice): Class pass will be lost and not refunded.
     

Chair Yoga Membership

Fully Non-refundable/non-transferable, unused classes will not be carried over.

Holistic Therapies (including Energy Healing, Reflexology & Massage):

  • A £20 deposit is non-refundable and cannot be transferred to another client.

  • All Holistic Therapy appointments require 24 hours’ notice for cancellations or transfers.

  • Early Cancellation (24+ hours notice): Your session will be transferred to another date.

  • Late Cancellation or No Show (less than 24 hours notice): The deposit will be lost and not refunded.
     

Courses & Workshops:

  • Non-refundable once booked. Strictly no cancellations or refunds under any circumstances.
     

121/Private Sessions:

  • 24-hour cancellation policy: If canceled within 24 hours or if you fail to show up, the full session fee will be charged.
     

ARRIVAL & LATENESS

  • Arrive early: Please come 5-10 minutes before the class starts.

  • Late arrivals: If you arrive after class has begun, you will not be allowed to attend, as this disrupts the flow of the class. This will be treated as a late cancellation or no-show.
     

WAITLIST

  • If a class is full, you can join the waitlist. If a spot opens up, you will receive an email notification.

  • Important: If you are added to the class, you will be charged for the session or have the class deducted from your pass.
     

WHEN WE MAKE CHANGES

We reserve the right to cancel or modify class schedules and substitute instructors as needed. If a class is canceled, we will transfer your session to another suitable date or offer a refund for the single class purchase.

Note: We are not liable for any other costs or damages resulting from class cancellations or schedule changes.
 

REFUNDS

Fees paid upfront for memberships, services, or workshops are non-refundable once purchased.

By booking, you agree to the terms outlined above, helping us create a smoother experience for all members. 
 

ATTENDING YOUR SESSION

  • Please arrive no earlier than 10 minutes before your class, event, or session to ensure the space is prepared for you and to maintain its integrity.

  • In cases of late attendance, The Soul Collective may decide to refuse treatment and/or admission to your scheduled booking. Arriving late for a private session will shorten your appointment time, and you will not receive a refund if you are late or fail to show for a booked class – the cancellation policy will apply.

  • To ensure safety and integrity during sessions, entrances will be locked for a prompt start and will not be reopened until finished.

  • Come dressed for your session and bring your own mat and any desired equipment (eye pillow, strap, water bottle, etc.). While equipment is available, it's recommended to have your own mat if you practice regularly.

  • For workshops, events, and sound baths, please refer to the guidance on what to bring as stated in the joining instructions email sent 24 hours prior to the event.

  • A bathroom is available at the venues used.

  • Please remove shoes before entering The Calm Space. For safety reasons and because clients are barefoot, no crockery, glass, or breakable items are permitted in any area used for services provided by The Soul Collective.

  • If you have verrucas or similar foot complaints, please refrain from walking around barefoot.

  • Bring your own mat and equipment to classes with The Soul Collective. If you borrow a mat, please wipe it down after use.

  • In the event of a fire, exit through the nearest door and leave all belongings, meeting at the designated fire point in venues used by The Soul Collective.
     

FITNESS AND HEALTH

All clients participating in activities/therapies offered by The Soul Collective do so at their own risk. Clients must inform The Soul Collective of any injuries, disabilities, or concerns that may affect their ability to participate in activities/therapies prior to their session. It is advised not to participate without first seeking medical advice if there are any concerns regarding physical condition.

Clients with low/high blood pressure and/or cardiac irregularities should not attend sessions/therapies without permission from their doctor. Notify The Soul Collective of any circumstances affecting your health that may be exacerbated by continued use of our services.
 

PREGNANCY

If you are pregnant, please wait until your pregnancy is in the second trimester (after 12 weeks) before attending any sessions/classes. After 12 weeks, participation in classes/sessions is at the individual teacher's/practitioner's discretion, and if you do participate, you agree to do so at your own risk.
 

CONTRA-INDICATIONS

Yoga Sessions: All clients participating in any activities/therapies provided by The Soul Collective do so at their own risk. Clients must inform The Soul Collective of any injuries, disabilities, or concerns that may affect their participation in activities/therapies prior to their session and agree not to take part without first seeking medical advice.

Workshops, Events & Circles: These events may include various healing modalities, so please contact Nathalie with any queries regarding their suitability before booking and consult your doctor.

Sound Therapy (including Sound Baths): This treatment is not suitable for those with severe mental illness, those who are pregnant, and those with pacemakers and/or heart conditions, without written consent from their doctor.

Reiki: This treatment is not suitable for those with severe mental illness, those in their first trimester of pregnancy, and those with pacemakers and/or heart conditions without written consent from their doctor.

Indian Head/Holistic Massage: This treatment is not suitable for those in their first trimester of pregnancy and those with pacemakers and/or heart conditions without first obtaining written consent from their doctor.

The Soul Collective reserves the right to refuse access to any client if there are concerns regarding the suitability of the modality, including but not limited to:

  • The client being under the influence of alcohol or mind-altering substances.

  • Clear contraindications that limit the client’s ability to safely access services.

  • Intimidating or offensive behavior, whether physical or sexual.

  • Any actions that cause the Teacher/Practitioner to feel unsafe, disrespected, or abused.

  • Late attendance where The Soul Collective may exercise discretion in refusing treatment and/or admission.

  • Any service provided by The Soul Collective is complementary and will be refused if requested to avoid necessary medical treatment, surgery, or medication.

  • Evidence of red flag symptoms or suspicion of a notifiable disease requiring legal notification.

By participating in any service provided by The Soul Collective, you, the client, accept the risk of injury from performing any exercises and participating in any therapies/healing modalities. The Soul Collective accepts no liability for injury to you, except where such injury cannot be excluded by law.

By participating in any service provided by The Soul Collective, you, the client, agree to our full terms and conditions, which absolve The Soul Collective of responsibility for physical injury caused by any class/course/therapy/workshop or visit to any service location.
 

PRIVATE 1-2-1 SESSIONS & GROUP BOOKINGS

Private bookings are confirmed upon receipt of full payment, subject to a full 24-hour cancellation policy.

Yoga: A comprehensive consultation at the time of booking will help tailor the session(s) to meet your goals and requirements. 1-2-1 sessions can be shared with another yogi. These sessions can be booked at the comfort of your home at The Soul Collective's discretion, provided there is a safe space, parking, and access available. Travel costs may apply.

Holistic Therapies: A full consultation is provided at the beginning of your session.

Group Bookings: Contact Nathalie directly to discuss group bookings for three or more people at nathaliemanning108@gmail.com - Price on Application.
 

ONLINE YOGA CLASSES & RECORDINGS

Anyone participating in online services does so at their own risk, including live-stream classes and recordings. Participants accept full responsibility for their health and safety, including any injuries.

If you cannot attend a Live Session, a recording will be sent to you within 24 hours upon request. Recordings are available for 7 days.

The 24-hour cancellation policy also applies to online services. If you cancel within this period, you will be charged.

Please refrain from attending online sessions if you are uncertain about your ability to safely follow the instructions.

Note that live-stream yoga classes are recorded and available on-demand, which may include your participation in the recording.

Ensure you use a suitable, non-slip floor space and remove any potential obstructions before participating.

Ensure you are suitably able to participate in these classes and select those that best match your ability.
 

PERSONAL BELONGINGS

Personal items brought to any class or event with The Soul Collective are at your own risk. The Soul Collective is not liable for any loss, theft, or damage to personal property on the premises or traveling to/from venues.

We do not accept responsibility for loss or damage to personal possessions while using any service provided by The Soul Collective, except where such loss or damage cannot be excluded by law.

All lost and left property will be disposed of within 14 days.

DATA PROTECTION

The Soul Collective is dedicated to transparency regarding how it collects and utilizes personal data, especially concerning employees, suppliers, and clients/customers of our services. This policy applies to the personal data of all such individuals.

PLEASE NOTE: LIVE-STREAMED CLASSES/WORKSHOPS ARE RECORDED AND AVAILABLE FOR ON-DEMAND VIEWING, WHICH MAY INCLUDE PARTICIPANTS IN THE RECORDING.

DATA PROTECTION PRINCIPLES

The Soul Collective processes personal data in accordance with the following principles:

  • Lawful, fair, and transparent processing.

  • Collection only for specified, explicit, and legitimate purposes.

  • Adequate, relevant, and limited data processing.

  • Keeping accurate personal data and ensuring inaccuracies are corrected or deleted promptly.

  • Retaining personal data only as long as necessary for processing.

  • Implementing appropriate measures for data security against unauthorized access, loss, or damage.

The Soul Collective will inform individuals of the reasons for processing their personal data and the legal basis for such processing through this policy. Personal data will not be used for other purposes.

When relying on legitimate interests for processing data, The Soul Collective will conduct an assessment to ensure those interests do not override the rights and freedoms of individuals.

Legal Basis for Holding Personal Data:
Personal data is held under the following GDPR provisions:

  • Consent: The individual has given clear consent for The Soul Collective to process their data for a specific purpose (e.g., signing up via Bookwhen, joining the mailing list, or newsletters).

  • Contract: Processing is necessary for a membership contract or because specific steps have been requested before entering into a contract.

  • Legal obligation: Processing is necessary for compliance with the law (excluding contractual obligations).

  • Vital interests: Processing is necessary to protect someone's life, such as emergency contact information.

  • Public task: Processing is necessary to perform a task in the public interest or for official functions, with a clear legal basis.

  • Legitimate interests: Processing is necessary for The Soul Collective’s legitimate interests or those of a third party, unless overridden by the individual's rights.

INDIVIDUAL RIGHTS

As a data subject, individuals have several rights concerning their personal data.

Subject Access Requests:
Individuals have the right to make a subject access request. Upon such a request, The Soul Collective will inform the individual:

  • Whether their data is processed, and if so, why, including categories of personal data and the source if not collected from the individual.

  • To whom their data may be disclosed, including recipients outside the EEA and the safeguards for such transfers.

  • The duration for which their personal data is stored (or how that period is determined).

  • Their rights to rectify or erase data, or to restrict or object to processing.

  • Their right to complain to the Information Commissioner if they believe The Soul Collective has failed to comply with their data protection rights.

  • Whether automated decision-making occurs and the logic involved.

The Soul Collective will provide a copy of the personal data undergoing processing, typically in electronic form if requested electronically, unless agreed otherwise.

To make a subject access request, individuals should send their request to nathaliemanning108@gmail.com.

In some cases, The Soul Collective may need proof of identification before processing the request and will inform the individual of the required documents.

Generally, The Soul Collective will respond within one month of receiving a request. If processing large amounts of data, this may extend to three months, with written notification provided within one month of the original request.

If a subject access request is deemed manifestly unfounded or excessive, The Soul Collective is not obliged to comply. Alternatively, a fee may be charged based on the administrative cost of responding.

A request may be considered manifestly unfounded or excessive if it repeats a prior request. If an individual submits such a request, The Soul Collective will inform them of the situation and whether a response will be provided.

OTHER RIGHTS

Individuals also have several additional rights regarding their personal data, including the right to require The Soul Collective to:

  • Rectify inaccurate data.

  • Stop processing or erase data no longer necessary for processing.

  • Stop processing or erase data if the individual's interests override The Soul Collective's legitimate grounds for processing.

  • Stop processing data during disputes regarding accuracy or the individual's interests.

DATA SECURITY

The Soul Collective takes personal data security seriously, implementing internal policies and controls to safeguard against loss, accidental destruction, misuse, or disclosure, ensuring data is accessed only by authorized employees in the course of their duties.

DATA BREACHES

If The Soul Collective discovers a personal data breach posing a risk to individuals' rights and freedoms, it will report it to the Information Commissioner within 72 hours of discovery and will record all data breaches regardless of impact.

INDIVIDUAL RESPONSIBILITIES

CLIENTS:
Individuals are responsible for keeping their personal data up to date and should inform The Soul Collective of any changes (e.g., address or bank details).

SUBCONTRACTORS:
Subcontractors working with The Soul Collective may have access to personal data during their duties. They must:

  • Access only authorized data for legitimate purposes.

  • Not disclose data except to authorized individuals.

  • Keep data secure, complying with rules on accessing personal data, and not storing it on local drives or personal devices.

  • Report any data breaches immediately to Nathalie Manning at nathaliemanning108@gmail.com.

Failure to comply with these requirements may result in termination of the subcontractor's agreement with The Soul Collective.

Deliberate or significant breaches, such as unauthorized access to employee or customer data, may be considered gross misconduct and could lead to immediate termination of services.
